These Terms of Service apply to your use of the Iron Raft website and purchases made directly from Iron Raft Ltd.

Please read them carefully before placing an order.

Nothing in these Terms affects any statutory rights which cannot legally be excluded.

2. Using Our Website

You may use our website only for lawful purposes.

You must not:

• misuse or attempt to interfere with the website;
• attempt unauthorised access to our systems;
• introduce malicious software;
• use the website for fraudulent purposes;
• scrape, reproduce or commercially exploit website content without permission; or
• use our intellectual property except as permitted by law or with our written agreement.

We may restrict access to our website where reasonably necessary for security, maintenance, legal or operational reasons.

3. Products

We take reasonable care to ensure product descriptions, photographs, specifications and pricing are accurate.

Product photographs are illustrative. Colours and appearance may vary depending on lighting, manufacturing tolerances and your screen.

Minor product or packaging changes may be made from time to time provided they do not materially alter the product you agreed to purchase.

4. Packrafting and Outdoor Activity Safety

Packrafting, paddlesports and other outdoor activities involve inherent risks and can result in serious injury or death.

Purchasing an Iron Raft product does not remove your responsibility to assess whether conditions, equipment and activities are appropriate for you.

Before using a product, you should:

• read and follow the instructions and safety information supplied with it;
• inspect the product for damage, wear or defects;
• use appropriate personal protective equipment;
• use an appropriate personal flotation device or buoyancy aid when required;
• wear an appropriate helmet where conditions require one;
• assess weather, water levels, currents, hazards and other conditions;
• ensure your skills and experience are appropriate for the activity;
• seek appropriate training where necessary; and
• avoid using damaged equipment or equipment you are unsure about.

You are responsible for making reasonable decisions about your own skills, experience and the conditions in which you use the product.

You must not knowingly use products outside their intended purpose, stated specifications or safe operating limits.

Modifications, improper repairs or inappropriate use may compromise the safety and performance of a product.

If you allow another person to use an Iron Raft product, you should make relevant instructions and safety information available to them.

Nothing in this section excludes or restricts liability which cannot legally be excluded.

5. Placing an Order

When you place an order, you are offering to purchase the relevant products subject to these Terms.

You are responsible for checking that the information supplied with your order is accurate.

We will normally send an electronic acknowledgement when an order is submitted.

We may decline or cancel an order before dispatch for reasons including:

• products being unavailable;
• an obvious pricing or description error;
• inability to authorise payment;
• suspected fraud;
• legal or regulatory restrictions; or
• an inability to deliver the order.

Where we cancel an order after payment has been taken, we will refund the relevant amount.

6. Pricing

Prices displayed on our website are in pounds sterling unless stated otherwise.

Prices will include applicable taxes where required.

Delivery charges and any additional costs will be shown before an order is completed where applicable.

We may change prices at any time, but a price change will not normally affect an order that we have already accepted.

If a product has been listed at an obviously incorrect price because of a genuine error, we may cancel the order and refund any payment made.

7. Payment

Available payment methods are displayed during checkout.

Payment services may be provided by Shopify, Stripe or other third-party payment providers.

You confirm that you are authorised to use the payment method supplied.

We may carry out or use third parties to carry out fraud and payment verification checks.

8. Delivery

Delivery destinations, charges and estimated delivery times are shown through our website or checkout where available.

Unless otherwise agreed with you, consumer orders will be delivered within the period required by applicable law.

Delivery estimates are estimates rather than guaranteed delivery dates unless we specifically agree otherwise.

9. Ownership and Risk

For consumer purchases, the goods generally remain at our risk until they come into your physical possession or the possession of a person you have identified to receive them.

Different rules may apply where you independently arrange a carrier that we did not offer as a delivery option.

Ownership of products will pass to you once we have received payment in full and the products have been delivered, unless applicable law provides otherwise.

10. Returns and Cancellation

Consumers purchasing online may have statutory cancellation rights.

Iron Raft also provides an additional voluntary returns policy on eligible products.

Nothing in these Terms limits your statutory consumer rights.

11. Faulty Products

Products supplied to consumers must be of satisfactory quality, fit for purpose and as described.

If you believe a product is defective, damaged or not as described, contact us at info@iron-raft.co.uk.

Depending on the circumstances, you may have rights to a refund, repair, replacement or price reduction.

Damage caused by misuse, accidents, normal wear and tear, improper storage, abrasion, puncture, impact, inappropriate modification, inappropriate repairs or failure to follow instructions will not normally constitute a manufacturing defect where those circumstances caused the problem.

12. Product Maintenance and Inspection

Outdoor equipment is subject to wear.

You are responsible for carrying out reasonable checks before use and maintaining your equipment appropriately.

You should stop using a product if you become aware of damage or deterioration that may affect its safe operation.

Repairs should be performed appropriately and in accordance with any relevant instructions.

13. Our Liability to Consumers

We do not exclude or restrict liability where it would be unlawful to do so.

This includes liability for:

• death or personal injury caused by our negligence;
• fraud or fraudulent misrepresentation;
• breach of statutory consumer rights where those rights cannot legally be excluded; or
• any other liability which cannot legally be excluded or restricted.

If we fail to comply with these Terms, we are responsible for loss or damage which is a foreseeable result of our breach or our failure to use reasonable care and skill.

We are not responsible for loss or damage that is not reasonably foreseeable.

We will not be responsible for injury, loss or damage to the extent it is caused by matters for which you are responsible, including misuse of a product, ignoring product instructions, inappropriate modification, using damaged equipment or knowingly undertaking an activity beyond your ability or appropriate conditions.

Where you purchase products as a consumer, we are not responsible for business losses, including loss of profit, revenue, contracts, opportunity or business interruption.

14. Business Purchases

If you purchase products wholly or mainly for use in connection with a trade, business, craft or profession, consumer rights may not apply in the same way.

If you require products for commercial, rental, guiding, instructional or professional use, please contact us before purchase where appropriate so that suitability and any applicable commercial terms can be considered.

15. Intellectual Property

Unless otherwise stated, the intellectual property rights in our website, branding, photographs, video, graphics, designs, text and other content belong to Iron Raft Ltd or our licensors.

You may access website content for personal, non-commercial use.

You may not reproduce, distribute, alter, sell, license or commercially exploit our content without our prior written permission except where permitted by law.

16. Third-Party Links

Our website may contain links to websites operated by third parties.

We do not control those websites and are not responsible for their content, availability, privacy practices or security.

17. Events Outside Our Reasonable Control

We will not be responsible for a delay or failure caused by events genuinely outside our reasonable control.

Where such an event materially affects an order, we will take reasonable steps to minimise its effect and communicate with you where appropriate.

Your statutory rights remain unaffected.

18. Severability

If any part of these Terms is found to be unlawful or unenforceable, that provision will be treated as modified or removed to the minimum extent necessary.

The remaining provisions will continue to apply.

19. No Waiver

If we do not immediately enforce a provision of these Terms, this does not mean that we have waived our right to enforce it later.

20. Changes to These Terms

We may update these Terms from time to time.

The Terms that apply to your purchase will generally be those in force when your order was placed unless a change is required by law.

21. Governing Law

These Terms are governed by the laws of England and Wales.

If you are a consumer resident elsewhere in the United Kingdom, you retain any rights you have under applicable law and may be entitled to bring proceedings in the courts applicable to where you live.
